Suluman Tyob appeared at the Newcastle Magistrates Court on Wednesday, 24 December 2025, where family, friends and residents gathered in support of the Oosthuizen family, holding placards demanding that Tyob not be released.

Supporters of both sides filled the gallery as Magistrate Shabanga presided over the hearing. The court considered whether Tyob, facing murder and assault with intent to do grievous bodily harm, should be released pending trial.
Tyob’s attorney, Zubair Chothia, presented his client’s affidavit, noting that Tyob worked at a local car wash and relied on the income to support his elderly parents.
Chothia argued that detention would jeopardise both his employment and his family’s wellbeing.
He also raised health concerns, stating that smoking in prison cells aggravated Tyob’s asthma, and argued that remaining in custody would limit his ability to prepare his defence.
Following this, the State did not oppose bail. The investigating officer assessed that Tyob was unlikely to interfere with witnesses, obstruct the investigation, or intimidate anyone involved. “However, we will require the accused to hand over his passport to the State,” the prosecution said.
After weighing the submissions and Tyob’s circumstances, Magistrate Shabanga granted R2 500 bail, allowing him to leave custody for the holiday period. The case is scheduled to continue on 13 February 2025.
The decision prompted anguish from Henrico’s family. His father, Tobie Oosthuizen, described it as horrifying that a 26-year-old man accused of striking a 17-year-old with a steel pipe could be released. Henrico’s mother, Nadia Oosthuizen, questioned what further evidence was needed. “My child died with so much damage done to his body,” she said.
Looking at incident, Henrico’s death followed an incident in Hutten Heights on 6 December 2025.
Henrico and his cousin and close friend, Dederick Marx, were walking home after playing pool when they encountered an unrelated altercation on Gemsbok Street. Henrico intervened to protect another young man and was struck on the head with a pipe. Marx was also attacked and injured but survived.
Both teenagers left the scene, but Henrico’s condition worsened overnight. He suffered seizures and was rushed to hospital. Despite intervention, he passed away on 8 December 2025. Marx survived physically but was left injured and traumatised.

If you have taken a life there should be no options for you; and we’ve got how many illegal immigrants in our country; you think him not having a passport will keep him from fleeing the country.

This young lad smokes and drinks. Smokes both cigarettes and weed yet there lawyer claims he has asthma. Even if so he does. He smokes himself.
Word has it the lawyer paid off people on their behalf.

What can we say… They concerned about his asthma… He killed my 17 year old son… He is a grown man against my 17 year old child… My son is not here to defend himself… But we have to relay on the state that had failed us all… They worried about his parents… What if it was my son that had that pipe in his hand that night… What harm did my 17 year old son do to that man… Does he have any scratches or brushes on him no… But he is a grown man that desided to take my son’s life that night…. I feel your pain. However what was your 17 year old son doing in a pub. Then in the streets that time of the night. Also we only hear one side of the story. Yes I agree the accused is wrong however ask what provacate the situation?

He did not think about the consequences of his actions when the incident occurred. What about Henrico’s parents? They did not get to take their son home to take care of him. #justiceforhenrico

This again shows that killing is South Africa is becoming a national sport, that lady that stole the peoples holiday money got R100 000 bail but for murder you only need to pay R2500 bail. The parents must get ask that the case be heard in another town , he is connected with people in high places.

Double standards in Newcastle, innocent people who are accused are denied bail yet a man guilty of killing a 17 year old is released in bail R2500 bail, this is utterly disgusting, what stops him from doing it again and again, his a murderer and must be treated like one, and what nonsense, he does not support his family, he uses his money to support his drug habit, his dad works n provides for the family. The deceased family needs to request this case be taken to another town because you will not get justice in Newcastle.
R2500 bail for such a hideous crime!!!!!! That judge should be inspected cause how give bail to someone that commited a murder and such a silly amount for bail aswell!!!!!! Now he is free to just go on with his life, work and walk free but Henricos parents are suffering in pain??? Unacceptable really.in SA you can steal, murder and do vicious crimes as here all treated as petty crimes and other not so serious cases have bails set of R100 000 plus.
