The KwaZulu-Natal Health Portfolio Committee is set to seek legal guidance after being blocked from compelling the Madadeni Provincial Hospital Chief Executive Officer (CEO) to appear before it, escalating a standoff with the KwaZulu-Natal Department of Health over accountability in the case involving a doctor accused of sexually assaulting four patients at the state facility.

The impasse has effectively halted the committee’s attempt to obtain direct answers on what action the hospital has taken in response to the allegations against Dr Syham Prabhakaran Nair.

This, coupled with whether adequate safeguards have been implemented to protect patients and prevent further breaches of trust within the institution.

Speaking to Newcastillian News, Chairperson of the KwaZulu-Natal Health Portfolio Committee, Dr Imran Keeka, confirmed that the CEO had been formally summoned to appear before the committee on Friday, 15 May 2026.

However, that appearance was blocked after the Department of Health intervened, arguing that the provincial legislature does not have the authority to compel a departmental official to comply with such a summons.

Dr Keeka said the committee would now escalate the matter for legal scrutiny before determining its next course of action.

“We will now be approaching our legal team to check the legalities around this, and once we have received the necessary feedback, we will then take the necessary steps, as we believe that the KZN Health Portfolio Committee has the right to know what steps have been taken by the Hospital,” he stressed.

The confrontation has added a procedural and constitutional layer to an already sensitive matter, with the committee having initially sought clarity not only on the hospital’s internal response to the allegations.

But, also on how disciplinary processes within the facility align with criminal proceedings and the regulatory frameworks governing medical practitioners.

“Consequences must extend beyond the courtroom if the matters are deemed valid. The safety and dignity of patients in our public health facilities are non-negotiable.”

Against this backdrop, Dr Keeka reiterated that while such incidents are not frequent, they require immediate escalation when serious allegations are raised against healthcare professionals.

He further emphasised that hospitals carry a clear obligation not only to monitor such matters internally, but also to report them timeously to the relevant authorities for investigation and oversight.

“Not only do medical facilities need to monitor any serious allegations, but it is their duty to report such matters to the official authorities, and the KZN Health Portfolio Committee will be following up on this, and we will be having a meeting with the Hospital’s CEO once our legal team provides us with the necessary feedback,” he said.

For context, Dr Nair was arrested on 28 April 2026 in connection with allegations that he sexually assaulted four patients between August 2025 and April 2026 while working at Madadeni Provincial Hospital.

According to KwaZulu-Natal SAPS spokesperson Colonel Robert Netshiunda, the alleged conduct involved repeated and invasive sexual acts during patient consultations.

“The suspect would allegedly touch the victims inappropriately on their breasts and private parts, and he also allegedly forced some of them to perform sexual acts on him,” he said, adding that the matter only came to light after the victims confided in a whistleblower, who then escalated the complaint to police.

Meanwhile, Dr Nair remains out on R15,000 bail, granted by the Madadeni Magistrate’s Court during his appearance on 8 May 2026, as the criminal case proceeds alongside heightened institutional scrutiny and mounting questions regarding oversight within the hospital system.

The State did not oppose bail, citing that the accused was not considered a flight risk, was unlikely to interfere with witnesses, and that his release was not expected to trigger public disorder.

Furthermore, the standoff between the committee and the Department of Health now shifts the focus from the underlying allegations to a broader question of institutional accountability and legislative oversight.

As legal advice is sought, the outcome is likely to clarify not only the committee’s powers in compelling senior officials to appear before it, but also the procedural boundaries that govern engagement between provincial departments and oversight structures.
