KZN businessman, Jan Hendrik van Zyl (also known as Henk) has yet again found himself in hot water. This comes after he apparently failed to abide by the court judgement handed down in October 2020.
If you remember, Van Zyl owned a company named QPT Trading with offices in Amanzimtoti and Ballito with the head office situated in Newcastle, KwaZulu-Natal.
At the time, the Newcastillian – Online News reported on the matter and explained how van Zyl was convicted by the Durban Specialised Commercial Crime Unit, which found him guilty of fraud by means of misrepresentation.
At the time, Hawks spokesperson, Captain Simphiwe Mhlongo explained that during van Zyl’s trial, the court heard how Van Zyl told his victims that he was investing their cash in Forex Trading, promising them a 5% return per month—with these crimes committed between 2009 and 2014.
Moreover, Captain Mhlongo added that after the contracts were signed, and van Zyl had paid out a few monthly returns, he abruptly discontinued the payments.
According to reports, he allegedly managed to secure R7 million from his unsuspecting investors.
While almost R 4.5 million was recovered and paid back to the investors, van Zyl was ordered to pay back the outstanding amount of R2.4 million and pay instalments of R40 000 per month.

However, Van Zyl has apparently failed to comply with the court order. This is after the Hawks revisited the case and found that the businessman was allegedly not making the respective payments.
While reports have stated that van Zyl was arrested after this discovery, Hawks spokesperson Captain Simphiwe affirmed that the Hawks were not aware of the businessman being arrested. However, van Zyl appeared in court, on 5 August 2022, when the Hawks found that he had not fully complied with the court order.
He was brought to court again on 8 August 2022. “The case was remanded until later this week,” explained Captain Mhlongo.
Further legal steps will then be taken against van Zyl if he is found guilty. It is important to note, that during his conviction in 2020, it was stipulated that 10 years imprisonment, was wholly suspended for 5 years. This is on the condition that he is not found guilty of the same offence during the period of suspension.
